On April 15, 2024, in Docket No. EL24-90-000, Energy Management Solutions, L.L.C. v. PJM, PJM filed an answer at the Commission to Energy Management Solutions, LLC’s (EMS) March 15, 2024 complaint (Complaint). The Complaint alleges that PJM’s denial of EMS’s membership application in January 2023 violated the PJM Operating Agreement. PJM’s answer demonstrates that denying EMS’s membership application was entirely consistent with PJM’s obligations under the PJM Tariff and Operating Agreement.

On April 12, 2024, in Docket No. EL21-91-003, FERC issued a notice that the Motions Commissioner denied the Settling Parties’ (which includes PJM), Appeal of the Order Denying Motion for Reconsideration or Interlocutory Appeal in the Black Start Service Capital Recovery Factor or CRF Federal Power Act section 206 proceeding. Accordingly, the Motions Commissioner will not refer to the full Commission the interlocutory appeal filed by the Settling Parties following the orders issued by the Presiding Judge denying the requests to certify the contested settlement filed in this proceeding.

On April 12, 2024, in Docket No. ER24-1743-000, PJM submitted a ministerial clean-up filing to ensure that the eTariff records correctly reflect the language in the PJM Tariff and Operating Agreement that was accepted by the Commission as of various effective dates but displaced as a result of certain filings in Docket Nos. ER24-462 and ER19-469.
